Membership Terms and Conditions


These are the Terms and Conditions between TRG - The Roman Gladiators Pty Ltd                ABN 20 678 215 766                                                                                                                                                                                                                                      (“TRG”, “Academy”, “Club”) and the membership who has been provided.
Information published on this website is provided for the use of its visitors and you are
advised that, although care has been taken to ensure technical and factual accuracy,
some errors may occur. No guarantee is given of the accuracy or completeness of
information on these pages. Please be aware that TRG may alter the information on its
website from time to time. TRG shall have no liability arising from the use by any party of
the information on this website. TRG does not warrant the information on this website in
any way and in particular no warranty is given that the website or its contents or
hypertext links are virus free or uncontaminated. You are advised to make your own
virus checks and to implement your own precautions in this respect. TRG exclude all
liability for contamination or damage caused by any virus or electronic transmission


THIS IS AN IMPORTANT DOCUMENT – PLEASE ENSURE THAT YOU READ IT
CAREFULLY.

1. Membership Access: The member is entitled to use and access the Club facilities subject to the Club's conditions, rules, regulations, the terms of this membership agreement, and the specific terms and conditions of the membership selected by the member as set out in the documents provided to the member upon signing this agreement ("Agreement"). By signing, the member acknowledges having read and received these documents.

2. Compliance with Rules: Members must ensure that they read, understand, and abide by the Rules (“Rules”), which are notified to them through signage, handouts, or the Club’s website. Members must comply with any lawful and reasonable directions of the Academy’s staff and must not conduct themselves in any way that would present a danger to, or create a nuisance for, staff or other members using the Academy’s facilities.

3. Personal Information: During the process of entering into the Agreement and during the term of the Agreement, we will obtain access to certain types of your personal information, such as information relating to your health and financial position. We will only use, disclose, or deal with such information in accordance with our Privacy Policy. A full copy of our Privacy Policy is shown on our website www.theromangladiators.com.au.

4. Membership Commencement: You understand that your membership commences on the membership start date specified in this Agreement and is ongoing unless terminated in accordance with this Agreement.

5. Class Booking and Attendance:
5.1 The member, or the parent/guardian of the member, must download the club app immediately after creating the membership.
5.2 The member must book or cancel their class booking at least 24 hours prior to the class start time.
5.3 If the member misses a booked class and the class is fully attended, the member will be placed on a waiting list and cannot attend the class unless a spot becomes available.
5.4 If a member fails to attend a booked class and does not cancel the booking at least 24 hours prior, the management reserves the right to charge a $10 fee for the missed class.

6. Health and Fitness Disclosure: Provision of a safe and effective exercise program is dependent upon accurate health and fitness profiling. It is your responsibility to seek medical clearance prior to commencing any exercise program. You agree to disclose to us all relevant personal health and fitness information both prior to and during engagement in any exercise program, service, or facility we provide to you as part of your membership. This includes any health risk assessments, initial and periodic fitness assessments, and relevant information or recommendations provided by your medical practitioner. You further warrant and represent that you will not use the Club's facilities or any of our services or products while suffering from any infections or contagious illnesses, diseases, or other ailments or while suffering from any physical ailments such as open cuts, sores, or minor infections where there is a risk, however small, to other members and guests. We reserve the right to refuse entry or terminate memberships based on health reasons for the safety of our members.

7. Non-Medical Staff: The member acknowledges that our staff and contractors are not medical professionals and will not provide a medical opinion on which the member may rely.

8. Indemnity for Medical Costs: The member indemnifies TRG against all medical costs and expenses, including the costs of an ambulance when ordered by the Academy, for any injury or illness sustained at the club by the member or their guest, insofar as the injury or illness was not caused by the misconduct or negligence of the Academy.

9. Guardian Consent: In this Agreement, “member” includes a guardian if the member is under 18 years old.

10. Responsibilities of Guardians: If a member is under 18 years of age, the guardian:
10.1 Consents to the member being a member of the health club;
10.2 Has read and understands this Agreement; and
10.3 Will use all reasonable endeavours to ensure that the member complies with this Agreement.
10.4 Consents and agrees that members under 18 years of age may share classes and train with adults as part of their training and knowledge development.

11. Operating Hours: Operating hours may differ and will be communicated to members via email, website, and in-person.

12. Update of Personal Information: Members must promptly inform the Club of any changes to their address, phone contact numbers, email address, bank account, credit card details, or any other personal information relevant to their membership. Failure to update personal information may result in the cancellation or blocking of membership, with the member responsible for paying any outstanding fees until the minimum term of their membership is fulfilled.

13. Membership Suspension/Freeze:
13.1 The suspension/freeze is applicable for 1YCL (1 Year Lock Contract) ONLY
13.2 Membership suspension/freeze is available for a minimum of two (2) weeks and a maximum of twelve (12) weeks within any 12-month membership term. Further extensions will not be granted under any circumstances, including but not limited to illness or injury. A $5 per week hold fee applies while on hold, and your minimum membership term will be extended for the same period as your freeze.
13.3 If your membership payments are not up to date, any request for a freezing period will not be granted. Additionally, you will be reported to our debt collection agency to recover the outstanding balance.
13.4 Requests for a membership freeze must be made in writing to the Academy via customerservice@theromangladiators.com.au. Additional suspensions are at the sole discretion of club management upon the production of a valid medical certificate. Confirmation of the freeze is not accepted without written acknowledgment from the Academy.

14. Use of Personal Data for Marketing: To the extent of the law and in accordance with our Privacy Policy, the member consents to and authorizes the use and reproduction by TRG and its agents of information and details relating to the member's participation in the Academy’s activities, including but not limited to photographs, training results, comments, and testimonials, both written and recorded on audio and video, first name and initial, suburb, and age.

15. Advertising Use: The member fully understands that the above information may be used for advertising for the Academy.

16. Media Usage: To the extent of the law and in accordance with our Privacy Policy, you understand and agree that TRG may transmit photographs/films of images taken of such classes and fights for commercial and marketing purposes on its website and in publications, which may include but are not limited to photographs or videos on social media, posters, newsletters, and catalogues. TRG will take reasonable steps to securely store any photograph or video containing your image and ensure that neither TRG nor its employees use the photographs or videos for any unauthorized use or modify them inappropriately. These will be retained only for the intended purpose.

17. Indemnity for Media Use: You release and indemnify TRG, The Roman Gladiators Pty Ltd, its agents, officers, employees, contractors, instructors, coaches, administrative personnel, volunteers, and anyone else related to TRG The Roman Gladiators Pty Ltd from any claims and demands arising out of or in connection with the use of your image in such photographs/films, including but not limited to claims of breach of the Privacy Policy or Australian privacy laws, defamation, or financial compensation. Intellectual property in all photographic or video material belongs to TRG, and you agree to assign to TRG any personal, moral, or other intellectual property rights you may have in the material upon request and without further consideration.

18. Non-Use of Facilities: Non-use of the facilities by the member gives no right to a rebate, cancellation, or refund of the membership fee. If the Academy’s facilities remain closed during the advertised trading hours, then, under Fitness Australia regulations (“Hours of Opening”) - excluding any Public Holidays - the membership will be automatically credited for a period equal to the duration of the closure.

19. Refusal of Entry and Membership Termination: We can refuse entry to the Academy’s facilities, cancel your membership, and/or terminate the Agreement without warning or notice for inappropriate, threatening, or harassing behaviour, damaging equipment or facilities, or the use of illegal or performance-enhancing drugs in the Academy’s facilities. You may not conduct, promote, or solicit other business in the Academy’s facilities without prior permission from the management. No refunds will be issued. The exercise of this clause is at the sole discretion of the Academy's management.

20. Non-Refund for Illness or Injury: If you are sick, found ill, or injured outside of the Academy, there is no provision for a refund for the missed period.

21. Membership Tag Use: The member must use their active TRG membership tag before entry or present themselves to staff. Memberships are not transferable and must be shown on every visit to gain entry.

22. Misuse of Membership Card: The member acknowledges that if they allow their membership card to be used by another person for the purpose of obtaining admission, they will be deemed to have repudiated the Agreement. We may terminate the Agreement, and you will be liable to pay all monies due under this Agreement, including but not limited to all membership fees payable until the expiry of the Agreement.

23. Lost or Stolen Membership Tag: In the event of a lost or stolen membership tag, you should contact the Academy regarding the reissue of a replacement card. A fee of $100 will be charged by the Academy to cover the cost of the replacement card/tag.

24. Changes to Services and Facilities: The member expressly acknowledges that the Academy reserves the right to change the nature, format, presentation, or number of services and facilities as deemed suitable, including class schedules and equipment. As much warning of any changes as practicable will be provided for members' information on the Academy’s social platforms and/or website.

25. Membership Cancellation:
25.1 The holders of the NL-C (NO LOCK CONTRACT) must give 4 weeks' notice in writing prior to the end of the membership.
25.2 The holders of the 1-Year Membership Contract (1YMC) must fulfil the full remaining balance and provide 4 weeks’ notice in writing to end the contract.
25.3 Renewal Process: Memberships will automatically renew at the end of each term, continuing under the same structure and terms as the previous membership period.
25.4 Notification of Changes: Any changes to the renewal terms or membership structure will be directly communicated to members by Club management.
25.5 Exceptions: Unless otherwise communicated directly by Academy management, the automatic renewal will proceed under the established terms and conditions of the previous membership.
25.6 Outside of the minimum term, a member must give 4 weeks' notice in writing and pay the equivalent to four (4) weekly direct debit payments.

26. Cancellation Procedures: Any request for membership cancellation must be made in person at the Club's premises, along with written notice to customerservice@theromangladiators.com.au. A resignation form will need to be completed and authorized by the member.

27. Outstanding Payments: If a membership fee payment remains outstanding, you agree that, unless we are in breach of our obligations under the Agreement, we may continue to debit the nominated credit/debit account for the total amount due without notice to you.

28. Payment Structure:
28.1 Weekly membership fees are payable in advance.
28.2 For multiple memberships, the primary member will be responsible for the payment of the membership fees for all associated memberships.
28.3 If you fail to pay the membership fees by the due date, the Academy reserves the right to refuse entry to any Academy facilities until such outstanding payment is received.
28.4 The member's rights will be automatically suspended if the member is in default by not meeting their required membership payments under this Agreement. If any installment or fees are not paid on the due date and remain in arrears, then the full balance of the membership may become immediately payable upon demand.
28.5 Pre-paid memberships: All pre-paid memberships are non-refundable and non-transferable.
28.6 The member may not transfer their rights under this Agreement without the Academy’s consent. Upon approval from management and completion of the Academy membership transfer form, the balance of the minimum term and all rights under this agreement, including all financial requirements, will then be the responsibility of the new member listed as the person taking over the membership. (Note: The transfer is not valid unless an administration fee is paid on or before the time of request.)
28.7 Casual visit fees are applicable to non-members. If a member brings a guest without prior permission, notice, or a signed waiver, and the guest does not finalize their casual fee, the member may be charged a $200 tailgate fee.
28.8 If a payment is missed and we are required to contact you by: phone call, text message, or email, a $30 administration fee will apply for each follow-up attempt. However, if you notify us in advance or before the due date that a payment will be missed and arrange an alternative, no extra charges will apply.

29. Membership Types:
29.1 1YMC – 1 Year Membership Contract:
Members enrolling under the 1-Year Membership Contract (1YMC) agree to a commitment period of 52 weeks from the date of signing the contract. The 1YMC offers members a discounted membership fee rate in exchange for this 52-week commitment.

29.2 NL-C – No Lock contract:
Members enrolling under the No Lock Contract (NL-C) agree to a commitment period of 4 weeks, with payments due weekly. The NL-C comes with a full membership fee due to the shorter commitment period. It will automatically renew at the end of each 4-week period unless the member communicates a desire to terminate the contract before the renewal date.

29.3 UPDATE MEMBERSHIP/CONTRACT:
For Clarification of previous contract poins: the Club will not grant any downgrades of membership under any circumstances. Members may upgrade their membership at any time. If the upgrade is to a 1-Year Membership Contract (1YMC), the current membership will be cancelled, with any outstanding amount from the previous contract waived, and a new 1-Year Membership Contract will be created. The 52-week commitment period will commence from the date the new contract is signed. If you are choosing a No Lock Contract (NL-C), your plan will remain on a month-to-month renewal basis. Members wishing to move from a 1YMC to an NL-C must first pay the full outstanding balance of their current 1YMC and then submit an application to the Club to join the NL-C.

30. Classes Structure:
30.1 If the facilities are unable to provide scheduled services, any members who miss their training classes due to this will be eligible for make-up classes rescheduled by the club.
30.2 If a member misses the rescheduled make-up class, they are only eligible for another make-up class if there is an available spot within the same week, and this must be approved by management.
30.3 Make-up classes are not applicable if you are on holiday, sick, or unable to attend your scheduled training unless a prior decision has been made by management.
30.4 All requests for make-up classes must be communicated with management via email at customerservice@theromangladiators.com.au
30.5 All members must be registered in the club app and must book their own classes through the app.
30.6 Class Age Groups
The classification of class age groups at TRG – The Roman Gladiators Academy is based on general ability levels typically associated with each age range. This categorization is not tailored to individual preferences but is determined by the average capabilities of participants.
– Kids Classes: Ages 6 to 10 years
– Teens Classes: Ages 10 to 15 years
– Adult Classes: Ages 16 years and above
The TRG Management and Coaching Team reserves the exclusive right to assign or approve a member's participation in a different age group class, based on the member’s skill level, development, or other relevant considerations at their sole discretion.
30.7 Classes Structure:
ADULTS Classes General (subject to change):
– 2 times per week (1 Martial Art Only)
– 3 times per week (1 Martial Art Only)
– Unlimited classes (Any Martial Arts)
– Fighters Classes (Exclusively for fighters only)

TEENS Classes (subject to change):
– 1 time per week (1 Martial Art Only)
– 2 times per week (1 Martial Art Only)
– 3 times per week (1 Martial Art Only)
– 4 times per week (1 Martial Art Only)

KIDS Classes (subject to change):
– 1 time per week (1 Martial Art Only)
– 2 times per week (1 Martial Art Only)
– 3 times per week (1 Martial Art Only)
– 4 times per week (1 Martial Art Only)

SPECIFIC Classes (subject to change):
Fighter / Female / Fitness / Foundation / General / Open Mats / Sparring

31. Personal Training (PT) Sessions
31.1 Booking and Payment
All PT sessions must be booked at least 24 hours in advance via the Club’s app, website, phone, or front desk. Sessions may be booked up to two weeks in advance and are first-come, first-served. All sessions must be paid in full at the time of booking. A 10% discount applies when purchasing 10 sessions upfront. Packages are non-refundable and valid for 6 months.
31.2 Session Types and Fees
All PT sessions are 60 or 45 minutes. Options include: In-Person / Phone / Online. Available coaches: Main Coach, Skilled Coach. Phone/online sessions may cover technical breakdowns, performance feedback, general nutrition advice, or fight planning.
31.3 Cancellations and Rescheduling
Cancel at least 12 hours before the session. Late cancellations are charged 100%, unless replaced—then 50% may be charged. Rescheduling within 12 hours is subject to availability and may incur a 25% fees.
31.4 Attendance and Punctuality
Arrive at least 5 minutes early. Late arrivals do not extend the session. If the trainer is late, time will be extended or credit given.
31.5 Trainer Availability and Substitution
Trainer requests are subject to availability. The Academy may substitute trainers or reschedule due to unforeseen circumstances. Members will be notified and may reschedule or receive credit.
31.6 Conduct During Sessions
Phones must be on silent. Members must follow instructions. Disrespectful behaviour leads to immediate termination and possible suspension of booking rights.|
31.7 Health and Safety
Members must disclose injuries/conditions before training. Injuries must be reported the same day with an injury form. TRG staff are not medical professionals. Participation is at your own risk. TRG is not liable except in cases of gross negligence.
31.8 Refunds and Transfers
Refunds are granted only under exceptional circumstances with management approval. PT sessions are non-transferable. Expired sessions are non-refundable.
31.9 Feedback and Complaints
Feedback is encouraged through the club system. Complaints must be submitted on the same day to management.

32. Payments and Debt Recovery
32.1 A 5% or higher compound interest may apply on dishonored payments.
32.2 If your direct debit, bank account, or credit card payment is declined due to insufficient funds or any other reason, our system will automatically attempt to retry the payment two times. A fee will be applied each time the system attempts to collect the funds. If payments remain outstanding for two consecutive weeks, the total amount owed will be immediately referred to our debt collection agency (see Clause 35.6 for fee application).
32.3 Any debts that remain unpaid for 14 days, equivalent to 2 outstanding weeks (unless a prior payment arrangement has been made), will be referred to a debt collection agency. All costs and fees associated with recovering such debts will be passed on to you (see Clause 35.6 for fee application).
32.4 Changes in services may result in additional fees.
32.5 Services are paused until outstanding amounts are paid. Continued non-payment may result in legal recovery, with all costs charged to the member.
32.6 If your account is referred to debt collection, the following fees will be applied to your outstanding balance:
        - 25% of the total amount owed to TRG,
        - 5% fee applied by Payrix on your account, and
        - Any additional legal or recovery fees charged by the debt collector.
If you fail to settle the outstanding amount after referral, legal action will be taken by the debt collector, and further costs will be added to your account.

33. Annual Fee Increases
Membership fees may increase annually at TRG’s discretion. Fees are recovered from your nominated account.

34. Member Health Warranty
34.1 The member (or guardian) warrants that the member is medically able to exercise and use the gym.
34.2 The member confirms no known health condition that could worsen with physical activity.

35. No Medical Warranties
TRG makes no medical claims or guarantees about its programs, advice, or facilities.

36. Security Monitoring
TRG facilities may be monitored for safety and security purposes.

37. Smoking Prohibition
Smoking is strictly prohibited inside and around the Academy, including entrances and the car park.

38. Indemnity and Release
The member (or guardian if under 16) releases TRG and its staff from all claims:
(a) Related to illness, injury, or health deterioration from participation or advice.
(b) For injuries sustained inside or around the Academy due to member’s breach of terms.

39. Limitation of Liability
TRG limits liability (except in case of death or personal injury) to the total value of the member’s fees in the previous 12 months.

40. Legal Capacity

Members must have the legal capacity to enter into this Agreement (i.e., be 18 years of age or older). If the member is under 18, they confirm that they have obtained parental or guardian consent prior to entering this Agreement, and the signature provided is that of the member’s parent or guardian.

41. Acknowledgment of Risks
The member (or guardian of a member under 18) accepts that physical activity carries inherent risks of minor or major accidents, illness, injury, or death. All participation in Academy facilities or activities is at the member's own risk.

42. Operating Hours and Facility Closures
TRG will maintain regular opening hours, except when affected by events beyond its control (e.g., fire, war, government mandates, strikes). If facilities are temporarily closed, TRG will offer access to reasonable substitute facilities within its network where possible.

43. Cancellation by TRG
TRG reserves the right to cancel this Agreement at any time by written notice. At its discretion and acting reasonably, TRG may refund any unused portion of the membership attributable to the period after cancellation.

44. No Property Rights
This Agreement does not grant the member any ownership, managerial, or financial interest in the Academy, its premises, profits, or operations.

45. Contractor Services
Some services at the Academy may be provided by independent contractors (e.g., Personal Trainers, Instructors). Fees for these services are paid directly to the contractor. TRG is not responsible for these services or payments. Any claims arising from contractor actions must be addressed directly with the contractor. The member agrees to indemnify TRG against any such claims.

46. Amendment of Rules
TRG management reserves the right to amend the Rules and modify or update the fitness services at any time without prior notice.

47. Prepaid Membership Termination
Prepaid memberships terminate automatically at the end of the agreed prepaid term. Unless otherwise stated in this Agreement, all prepaid fees are non-refundable.

48. Child Safety and Liability
The member/guardian acknowledges that any child/children accompanying them are present at the Academy at their own risk. TRG will not be held liable for any incidents involving children on the premises.

49. Food and Beverage Risks
Members acknowledge that the consumption, spillage, or mishandling of hot or cold food and beverages is at their own risk. TRG is not liable for any injury or illness (including burns or cuts) suffered by members or guests due to food or beverage incidents.

Upon turning 18 years of age, a youth member will automatically have their weekly membership payment adjusted to the Adult Weekly rate for the remaining balance of their minimum term. Updated rates are available upon request.

51. Property Liability
TRG is not liable for damage, loss, or theft of property on the premises, including items left in lockers or the carpark. TRG does not act as a bailee of members’ personal property.

52. Non-Waiver of Rights
If TRG chooses not to enforce its rights at any point due to a member’s breach of this Agreement, that choice does not constitute a waiver of TRG’s rights to enforce those terms at a later time.

53. Agreement Renewal and Changes
Any renewal or extension of this Agreement is subject to possible updates at the Club’s discretion. Members will be notified in writing of any changes. The updated Agreement will apply after the current minimum term unless the member submits written notice of cancellation within 7 days of receiving the new terms.

54. Relocation and Non-Refundable
Membership fees are non-refundable in the event that the Academy relocates within a 10-kilometer radius of its existing premises.

55. Acceptance of Terms
By acting in accordance with this Agreement, TRG affirms its acceptance of all terms and conditions outlined herein.

56. Club Property and Service Requests
Members must not remove, steal, or take any club property. To request a service or product, members must approach the front desk. If no one is available, the member must speak with a coach for further assistance and instructions.

57. Compliance with Food and Beverage Regulations
All drinks and coffee provided by the club comply with the food and beverage regulations established by the NSW Health Department.

- The availability of these classes depends on the availability of our female coaches. In urgent situations, to ensure continuity of service, male coaches may lead these classes if female coaches are not available.                                                                     

- In unforeseen circumstances, classes may be merged to maintain the continuity of service.
- Members are permitted to attend alternative classes available during the same period. This flexibility ensures that members continue to benefit from our services without disruption to their fitness routine. We encourage members to explore different classes as an opportunity to diversify their training experiences.

LIABILITY WAIVER

  • Physical Condition Declaration: To the best of my knowledge, I am in good physical condition and fully capable of participating in this course. I affirm that I have no known conditions that would prevent me from engaging in the physical activities involved.

  • Awareness of Risks: I am fully aware of the risks and hazards associated with participation in fitness activities, including but not limited to boot camp training, weightlifting, aerobics, cardiovascular fitness, kickboxing, MMA (mixed martial arts), Brazilian jiu-jitsu, judo, Muay Thai, Yoga, Pilates, Boxing, Wrestling, Grappling or any other physical activities requiring physical exertion, including all martial arts and combat sport listed in the NSW CSA regulation. I acknowledge that these activities carry the potential for physical injury or even death.

  • Voluntary Participation: I hereby elect to voluntarily participate in this course, fully understanding and accepting the risks involved. I acknowledge that the physical activities associated with this course may be hazardous to both my physical well-being and my property.

  • Assumption of Responsibility: I voluntarily assume full responsibility for any risks, including loss of property, property damage, personal injury, paralysis, or death, that may occur as a result of my participation in this course. I acknowledge that I bear full responsibility for any loss or damage to property owned by me that may arise from my involvement in these activities.
     

TRG Waiver and Acknowledgment

  1. Participation Risks
    Participation in fitness activities and/or combat sports involves inherent risks, which may include but are not limited to death, personal injury, and property damage. Specific risks include, but are not limited to: head injuries, spinal damage, bone fractures, sprains, strains, muscle tears, ligament damage, bruises, abrasions, open wounds, dislocations, dehydration, heat stress, heart attack, stroke, cardiovascular complications, infections, disease, or other injuries or illnesses related to overuse, exertion, or exposure.

  2. Minor Participant Safety
    The members, parent(s) and/or legal guardian(s) will instruct the minor participant that prior to engaging in any martial arts activity or event, they should inspect the facilities and equipment to be used. If the participant believes anything is unsafe, they should immediately inform officials and refuse to participate. I understand and agree that if at any time I feel anything to be unsafe, I will immediately take all precautions to avoid the unsafe area and refuse to participate further. Under 18 year of age might train with adults.

  3. Assumption of Risks for Minors
    The members, parent(s) and/or legal guardian(s) acknowledge and understand that participating in martial arts, combat sports, and physical activities that include, but are not limited to, sparring, grappling, kicking, punching, rolling, wrestling, and other contact-related activities.

  4. Responsibility for Injuries
    The members, parent(s) and/or legal guardian(s) assume full responsibility for any injuries, losses, or damages that the minor may sustain while participating in these activities, including any injury, loss, or damage caused by the negligence of The Roman Gladiators Pty Ltd, Damiano Scorsino, Cristina Motilica, its instructors, coaches, employees, agents, or any other participants.

  5. Waiver of Claims
    The members, parent(s) and/or legal guardian(s) release and waive any and all claims or causes of action against The Roman Gladiators Pty Ltd, Damiano Scorsino, Cristina Motilica, instructors, employees, agents, or any other participants for any and all claims, demands, or causes of action, including reasonable attorney fees and costs, arising from or in connection with the minor's participation in martial arts, combat sports, and physical activities.

  6. Indemnification
    The members, parent(s) and/or legal guardian(s) agree to indemnify and hold harmless The Roman Gladiators Pty Ltd, Damiano Scorsino, Cristina Motilica, instructors, coaches, employees, agents, or any other participants.

  7. Release and Covenant Not to Sue
    I/We hereby release, waive, discharge, and covenant not to sue the martial arts and/or combat sport facility used by the participant, including its owners, managers, promoters, lessees of premises used to conduct the martial arts event or program, premises and event inspectors, underwriters, consultants, and others who give recommendations, directions, or instructions regarding the martial arts facility or events held at such a facility. This release extends to their directors, officers, agents, employees, and others referred to as "Releasee," for any and all claims, demands, losses, or damages and any claims or demands therefore on account of any injury, including but not limited to the death of the participant or damage to property, arising out of or relating to the event(s) caused or alleged to be caused in whole or in part by the negligence of the Releasee or otherwise.

  8. Understanding of Risks
    I/We fully understand and acknowledge the following:

    • There are risks and dangers associated with participation in martial arts/combat sport events and activities which could result in bodily injury, partial and/or total disability, paralysis, and death.

    • The social and economic losses and/or damages which could result from these risks and dangers described above could be severe.

    • These risks and dangers may be caused by the action, inaction, or negligence of the participant or the action, inaction, or negligence of others, including, but not limited to, the Releasees named below.

    • There may be other risks not known to us or are not reasonably foreseeable at this time.

  9. Health and Fitness Warranty
    I warrant and represent that I am in good health and physical condition, and that I do not suffer from any health condition that may affect my ability to safely participate in the fitness activity and combat sports.

  10. Medical Advice
    I agree that if I have any concerns or reservations about my health or my ability to participate safely in the fitness activity and/or combat sports, I must seek advice from a medical professional before participating.

  11. Immediate Cessation of Activity
    I warrant and represent that if at any time I believe the conditions of the fitness activity and/or combat sports are unsafe for me (considering my health and physical circumstances), I will immediately stop participating.

  12. Responsibility for Personal Belongings
    I acknowledge that the provider is not responsible for the safety or security of my personal belongings while participating in the fitness activity and/or combat sports. If the provider offers lockers or any other place to leave personal belongings, I use them at my own risk.

  13. Medical Authorization
    I authorize the provider and the provider’s staff to provide first aid, seek emergency medical support, and/or transport me to a medical facility if I suffer an injury or medical emergency at any time. I acknowledge and accept that I will be responsible for any medical expenses incurred.

  14. Photography and Videography
    I authorize the provider and the provider’s staff to take photos or videos of me while participating in activities, and to use such photographs and videos for promotional purposes, including use on social media or other websites. If I do not want photographs or videos of me to be used by the provider for promotional purposes, I must notify the provider in writing.

  15. Financial Notice
    I acknowledge and understand that I forfeit all rights to sue the provider and the provider’s staff for any reason related to my participation in these activities.

  16. Waiver of Liability
    I, on behalf of myself, my heirs, assigns, administrators, executors, and next of kin, hereby irrevocably and unconditionally waive any and all claims, expenses, causes of action, debts, demands, damages, or other liabilities (hereinafter “liabilities”), whether direct or indirect, and whether known or unknown that I may have now or in the future against the provider and the provider’s representatives.

  17. CCTV Recording
    I acknowledge and understand that the facility has recording cameras (CCTV) for security purposes.

  18. Final Acknowledgment
    I acknowledge and represent that I have read the foregoing waiver of liability and hold harmless agreement, I understand it and sign it voluntarily as my own free act and deed; no oral representations, statements, or inducements, apart from the foregoing written agreements, have been made; and I execute this release for full, adequate, and complete consideration fully intending to be bound by the same.

 

ACADEMY RULES

#1 - Coach is always in charge

Leave your pride at the door, we’re all here to learn and support each other.

Arrive to class on time and line up in rank/experience order in uniform (Either a TRG rashguard or shirt).

Always listen and respect your coach and instructors at all times, permission and bowing is required before ever entering or exiting the mats.

If the timer is running and class is in session, you listen and follow instructions, not just for class but for the safety of the other members.

You keep rolling until the coach calls the end of the timer, no leaving the mats for any reason without asking the coach in charge first. Unless of course of illness, dizzy or injured.

#2 - Keep it clean!                          

Hygiene goes further than the bathroom - trash behaviour is not welcome at our academy.

We have a zero tolerance for bullies and swearing and expect high standards for all our students. We keep it respectful to coaches, instructors, each other and most of all yourselves.

Bow as you enter and exit the mat and to your training partners and touch gloves or hands before starting.

To keep you and your team mates safe, we also expect a high level of hygiene standards from everyone.

Always ensure hands and feet are clean before stepping on the mats, with all nails cut short. When off the mats, going to the bathroom or leaving the academy facilities - shoes or slippers must always be worn.

Take a shower before and after training as soon as possible and scrub well. Bring a sweat towel to minimise fluid transfer.

Keep all gym equipment clean and packed away when not in use and respect all equipment and minimise any damage where possible.

Children and Teens are not to use the equipment and weights to minimise risk.

Keep all food and drinks off the gym floor, a clean gym keeps us all safe.

Keep all cuts, abrasions and scrapes tapes and dressed. If any occur during training, ensure they’ve been disinfected and cleaned.

Don’t store your sweaty gear in a place they will stay damp and ensure you’re always wearing clean gear on the mats.

#3 - Stay honest

It’s your responsibility to keep all your details up to date with us to the best of your ability. We’re an academy that celebrates each other as a team so no one enters our gym a stranger. We require identification upon entering to cover any liabilities and so we get to know you for you.

Be considerate of each other in and outside of the mats and the discipline of the academy

Integrity is at the heart of our academy, if you want to take it easy or have a ‘slow roll’ - speak up to your teammates. Be upfront if you want to roll competitively and don’t prey on your team mates when they’re injured or tired.

With time comes experience, but in our academy it’s also about teammates and growth. If you’re sparring or partnered with someone new, support them and their journey, we’re all learning together.

#4 - Get hurt but don’t hurt yourself

We know that martial arts are a highly physical and active sport, so we’ll find ourselves with a few scrapes and bruises occasionally. Our TRG coaches are always well experienced and promote a safe training environment for everyone, but there are some simple guidelines to avoid getting hurt or hurting your partner.

Always ensure you’re wearing the correct training and protective gear when required.
Pain is not always weakness leaving your body, when in doubt - tap early, tap hard. And no matter what, always honour a tap.

Grabbing of hair, ears or fingers is not allowed, eye pokes and groin hits may be inevitable but if we find you’ve done so intentionally - we reserve the right to cancel your membership. Keep the etiquette and respect high and injuries low.

There’s a big difference between getting hurt with experience and hurting yourself though.

We have a zero tolerance policy for illicit drugs and alcohol, if we find you’re under the influence of drugs and alcohol while attending a class or sparring, we may terminate your membership and escort you off the property. Our team members and coaches safety are always what comes first.

Put yourself in the best position possible to avoid injury such as wearing appropriate exercise gear (sports shirts, rash guards, martial arts shorts). For this reason we don’t allow jeans or clothes that may cause damage to you or the gym property.
